TERMS AND CONDITIONS OF PURCHASE

The purchase and sale of these products shall be governed by the following general terms and conditions. The purchaser accepts them without exception. The contracting conditions and the purchase procedure are presented in English and Spanish. 

These general conditions of purchase are in force for all products and services offered on the web, and may be modified without notice, not affecting the changes to purchases already made. 

Identification of the parties

The parties involved in this contract will be:

  • The buyer or customer, will be the one who makes the purchase of products.
  • The seller will be the one selling the product: EVOLVERE SCIENCE LABS S.L., from now on Kobho Labs (hereinafter, the VENDOR) with VAT number B09848599, address at c/ Zurbano 23, Madrid, 28010 SPAIN and email address: info@kobholabs.com.

Kobho Labs is a website for the purchase of food supplements. Kobho Labs was born with the aim of redefining the world of supplements, looking for the highest bioavailability of them.

The buyers of the web will have the following services in their user account:

  • The product catalog.
  • Secure payment procedure. 
  • Confirmation of payments made and issuance of invoice.
  • Test for product recommendation.

Phases of the contracting process

Product selection

When browsing our website you will find all our products sorted by categories. The purchase of the products offered on the website is done by selecting the products, indicating the desired quantity. Once you have selected the quantity, you must click on the "Buy" button, which will add the products to the basket located in the upper right margin.

Validation of the purchase

Once your shopping cart has been accepted, the web will show a summary of the products that are in it, and the buyer can add more quantity or remove products from the cart as well as add any discount code you have. 

If you wish to add new products, repeat the steps described in the "Product selection" section.

If you are not logged in to our website, you will need to enter your shipping information and select your desired payment method. At this step you will be shown the shipping conditions to the selected address. You will also be able to provide additional information regarding the delivery of the product. However, we cannot guarantee that the carrier will be able to comply with your instructions.

If you have a discount coupon to apply to your purchase, enter it in the corresponding section.

To proceed to finalize your purchase, please use any of the payment methods we make available to you. It is possible that some of these methods may ask you for additional information to continue (user account of the platform, or access to your digital banking system). Once the payment details have been entered, you must accept the terms and conditions and privacy policy.

At the end of the purchase, the web will show a summary box with the purchase made. This information will also be sent to the email address you have provided.

In those cases in which there is a delay between payment and deposit, the delivery time will not begin to compute until the transfer is confirmed.

If you are a credit card holder and you detect that a fraudulent charge has been made on our website, please inform us as soon as possible to solve the problem. You can do so by e-mail to info@kobholabs.com

If once the purchase has been made, and before the shipment is made, you want to cancel it, please contact us by sending an email to info@kobholabs.com so we can help you.

Delivery of the product

The delivery time will be determined by the shipping company chosen for the shipment.  Under normal conditions, the shipping of our products will be the one that appears in the final purchase process and depending on the shipping method you have selected. Estimated delivery 24-48 hours. Once we receive the message that the order is ready, the delivery time set by the shipping company will begin to count.

In case of a delay caused exclusively by the transport company, the seller will be exempt from liability. From the moment we send our products until delivery to the final recipient, the carrier will be responsible for any damage caused, exempting the seller from liability. However, if any incident occurs in this regard, please let us know via email: info@kobholabs.com. 

It is possible that for reasons beyond our control or that of the transport company, or due to force majeure, you may not receive the products within the indicated period. If you do not receive your order within the period indicated above, please contact us at info@kobholabs.com.

Price

The prices of the products offered on the website are indicated in euros (€) including Value Added Tax (VAT).

Shipping costs are free of charge.

Once the payment has been made, all the conditions reflected here are understood as accepted without exception.

The offers and promotions will be indicated expressly, understanding that an excessively low price in comparison to the rest of products or equal to zero will be due to an error, so the final process of purchase of the product that has this error will not be carried out.  For any questions please write to: info@kobholabs.com

Shipment preparation time

The preparation time of the product for shipment will be approximately 24h from the time of purchase.

However, the preparation time depends to a great extent on the stock of the product. If this is insufficient, Kobho Labs will contact the buyer to inform him/her when stock will be available again and provide an alternative solution. 

Returns

Once the order is confirmed, it will not be possible to modify or cancel it. In some cases, before the shipment confirmation has arrived, it will be possible to request a modification or cancellation through our customer service department by sending an email to info@kobholabs.com, as long as the product has not been processed and has not left our logistics facilities. In no case the customer will be responsible for the cost of returns, which will be borne by the seller.

Steps for returns

All products purchased at www.kobholabs.com can be returned and refunded, provided that the intention to return is indicated within 14 calendar days of receipt, and that the other conditions defined below are met:

  1. Defective goods

Kobho Labs has the responsibility to limit the situation of defective goods. In the case of compliance with the money back guarantee, the refund or credit of the amount paid will be returned to the purchaser of the product, discounting in any case, the transport costs.

In the event that the order was tampered with (shipping box opened, torn, empty or other situation that does not offer the security that could legitimately be expected, taking into account all the circumstances and especially its presentation, the reasonably foreseeable use of the same and the time of its release), in the case of compliance with the money back guarantee, the refund or credit of the amount paid will be returned to the purchaser of the product. The costs of this return shall be borne by the seller.

Steps to follow:

  1. Photograph the product so that you can see the damage caused by transport and / or damage to the product.
  2. Contact our customer service department to provide us with all the details of the product, via email to info@kobholabs.com.
  3. Once we have received the email, we will contact you to process the return shipment indicating how to proceed, which will be as follows: take the product to the post office and process a cash on delivery return.
  1. Return for withdrawal

For the return shipment, the same cardboard box used to receive the product must be used to ensure that it is well protected. In the case of not having this box, the customer must return it in a protective box so that the product arrives in good condition to our warehouses.

The products to be returned must be unused and in the conditions in which they were delivered, that is to say, with all their original packaging, manuals and accessories.

The amounts paid for the item/s will be refunded. 

In no case will they be returned if they have been opened.

Upon receipt of the request to exercise the right of withdrawal, we will proceed to refund the amount paid for the product or products returned. The return request must be submitted within a maximum period of 14 calendar days from the time of receipt. The refund will always be made through the same payment method used by the customer. Return costs will be borne by the seller.

Include a copy of the invoice in the shipping box, where the products shipped are marked.

Steps to follow:

  1. Contact info@kobholabs.com to provide us with all the details of the product via email.
  2. Prepare the package for the return as indicated in the previous section.
  3. Once we have received the email, we will contact you to process the return shipment indicating how to proceed, which will be as follows: take the product to the post office and process a cash on delivery return.

What will Kobho Labs do?

  • Upon receiving the products, we will proceed to examine them and then we will inform you whether or not you are entitled to a refund of the amounts paid for the purchased product(s).
  • We will proceed to refund the purchase price, once we have verified that the reason for the return is correct and not due to negligence on the part of the buyer.
  • The return process will be carried out as soon as possible and, in any case, within 5 days from the date on which the products are received. The return will be carried out using the same method of payment with which the purchase was made, i.e. if the purchase was made by credit card, the amount to be returned will be credited to the same card; if the purchase was made by bank transfer, the refund will be made by bank transfer. The data required for the return must be sent by the customer by email to info@kobholabs.com. The seller will bear the cost of returning the products, as indicated above.
  • Returns of products that are not in the same condition in which they were received, or that have been opened, will not be processed.
  • All product sizes and formats shown on our website are subject to some variation due to a change in presentation or minor formulation adjustments. There may be a slight period of time between when we receive new product items and the information is updated on the website. As it is the same reference we do not process refunds in these cases.

EVOLVERE SCIENCE LABS S.L. only ships to:

Peninsula and Europe.

Shipments are free and delivery times are calculated in the shopping cart according to the products and place of delivery. 

Privacy Policy

In compliance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and the free movement of such data and Law 3/2018 of 5 December, on Data Protection and guarantee of digital rights we inform that the data provided will be processed for the corresponding purpose indicated in the privacy policy.

Cross-border dispute resolution

If you have had any problems about how we have managed your online purchase, we inform you that a European platform for dispute resolution for online contracts is available. Thus, for the resolution of consumer disputes (pursuant to Art. 14.1 of Regulation (EU) 524/2013), the European Commission provides an online dispute resolution platform which is available at the following link:

Updating of the conditions

Due to legislative and jurisprudential changes, it is possible that these conditions may undergo variations in order to adapt to the new regulatory reality. Therefore, we recommend that you consult these conditions of purchase frequently.

Rights and obligations of the parties

Kobho Labs reserves the right to modify these Conditions at any time. In the event that, after the modification, the buyer does not agree with the new Conditions, he/she will have the right to delete the user account.

Limitation of liability

In case Kobho Labs suffers any kind of damage derived from the fault of any of the parties, either directly and/or indirectly, the causer commits to indemnify Kobho Labs, especially when there is misconduct, illicit, malpractice or professional negligence.

Kobho Labs is not responsible for a negligent use of the products, when these cause health problems to the buyer or third parties that use or consume our products.
